An international copyright

Copyright: American, European, or Global?

The word “copyright” signifies, initially, a concept of 'author rights' in American Law (U.S. Code Title 17).

In the United States, unlike the 'author rights' as understood in Europe (Belgium, France, Italy, Spain …), and in the 164 signatory countries of the Bern Convention, a registered copyright requires the deposit of the copyrighted material, not for the rights to exist, but in order to conclusively take advantage of the rights under U.S. law.

While in Europe, copyright is an automatic right upon creation of a work. Deposit of the material does not establish the rights, but proves the existence of the right.

Copyrighted status is indicated by the use of the copyright symbol ©, along with the year of publication and the name of the author (or the name of the company who owns the copyright to the work).

Our view of copyright, from the international perspective:

-Copyright is an automatic right, a right of the author, afforded by law without formal act.

- The copyright deposit of a work (literary, artistic, musical …) allows one to prove one's authorship. This allows an author to avoid the numerous undesirable situations where one cannot readily prove authorship or the date of authorship (a date certain and earlier creation are the keys to a lawsuit for copying or plagiarism.

- Rather than relying upon the rights of an American rights management company, the deposit of a copyrighted work provides an official and certain method to prove the creation, authorship, date of creation, deposit is valuable in all signatory countries (including the US) of the Bern Convention and allows depositing authors to assert their rights in all of these countries.

- Copyright value is extremely strong (as copyright deposit is Internet-accessible) in Europe or in the Americas.

- Copyright deposit needs to be completed once the work's creation is finalized.

- At each change of a work (updating, modification …), an author should redeposit his work to ensure that the most recent iteration is protected.
