What is a Copyright deposit ?1 – Storage:
The filing is the act of sealing with a judicial officer (bailiff, officer of the court, or notary) of a digital file or scanned document, which will be recorded in the official record of that officer. These are records for which the mandatory commitment to retain is 30 years.
This archiving and recording of the act are placed in a directory called Minutes of Acts, every one of which are performed with notarization, inscribed, and are traceable.
The term applies to a file that was registered by a judicial officer. This file is "filed" when the bailiff testifies to its registration, and sends his client a report of findings (“Finding PV”) on the deposit of the file.
The value to the author of the deposit and registration file by the officer is the certainty of the date of registration and information (this is an official act as the bailiff is a "delegate" of the State to establish acts, including the finding or recovery, for example).
We use the deposit by a bailiff to certify the record date, but also to ensure that the preservation (30 years, as required by decree) is effected by a judicial officer.
2 - Copyright
Copyright, outside the USA, is the word that reminds us of the copyright associated with the creation or work (artistic, literary, musical, visual ...). This right exists naturally as a result of the creation of a work. The author, the owner of the work at creation, has a right, but the existence and precise effect of this right could not be proven without the use of a strong authentication device of probative value. Copyright, and therefore the collection of royalties related to its creation, can be challenged without proof of creation and the date of creation.
The filing is the act that allows the author to register a creation by official order to prove the existence and ownership (intellectual property and possession) of the work called copyright.
Retention of a work and authentication of an author's copyright by a bailiff is an approach that facilitates copyright protection which offers authors a significant productivity, time, and cost savings because it occurs online.
